By accessing or using our websites, downloadable software installers, broadcast platforms, mobile applications, and APIs (collectively, the "Services")—including but not limited to EmajenDocs AI, Emajen®Sizer, Emajen®CAST (.exe desktop software), and Emajen®NDI Pro (.apk mobile software)—you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access the website or download any standalone software.
Subject to your compliance with these Terms, Emajen Solutions Inc. grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install, access, and use the Services for your personal creator workflows or internal enterprise business operations. The Services and their entire contents, features, and functionality (including but not limited to all information, artificial intelligence models, algorithms, software, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Emajen Solutions Inc., its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. "Emajen", "esi", and all related names, logos, product and service names, designs, and slogans are trademarks of Emajen Solutions Inc. or its affiliates.
Your privacy is paramount. When utilizing EmajenDocs AI, Emajen®Sizer, Emajen®CAST, or Emajen®NDI Pro, your telemetry and enterprise data are processed through our secure, zero-knowledge encrypted global network. We do not use your proprietary documents, video feeds, or live streams to train foundational AI models without explicit opt-in consent. In no event shall Emajen Solutions Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
These Terms shall be governed and construed in accordance with the laws of the jurisdiction of our Global Headquarters in Tarkwa, Ghana, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
